What is an FIR

A First Information Report is the written complaint filed with the police about a cognizable offence. Under CrPC s.154 the SHO must register an FIR for a cognizable offence — no discretion, no delay.

Steps

1. Go to the police station with jurisdiction over the place of occurrence.
2. Narrate the offence; the SHO writes it in the FIR register.
3. Read it carefully OR have it read aloud to you.
4. Sign it. Keep your free copy.

If the police refuse

1. Send a written complaint to the District Police Officer (DPO).
2. If still refused, file an application before the Justice of Peace / Sessions Judge under CrPC s.22-A & 22-B.
3. The Justice of Peace can order the SHO to register the FIR.
